A jury in the 399th District Court convicted 27-year-old Brandon Murphy of Indecency with a Child by contact and Indecency with a Child by exposure. Subsequently, the judge sentenced on Nov 16, 2023, Murphy to 11 years in the Texas Department of Corrections for Indecency by contact and 10 years for Indecency by exposure.
As the longest sentence, the 11 year sentence controls because the sentences will run concurrently. In addition, defendant Murphy will have to serve at least half of his sentence before being eligible for parole. Murphy will also have to register as a sex offender in accordance with Texas law.
The jury determined beyond a reasonable doubt that Murphy inappropriately touched the victim, who was 6 years old at the time, throughout the summer of 2016. The victim did outcry to an adult in 2017, but the adult did not report the outcry to police. The victim made a second outcry at school in 2019 which led to the investigation and subsequent prosecution.
"Cases involving the sexual abuse of young children are difficult to see and often difficult to prove, said Bexar County Criminal District Attorney Joe Gonzales.
