Russell Niemeier, 55, of Boerne, Texas, was sentenced on May 8, 2025, to 14 years in the Texas Department of Criminal Justice - Institutional Division for Burglary of a Habitation. The sentencing followed his conviction in the 451st District Court of Kendall County, with the Honorable Judge Melvin "Rex" Emerson presiding.
The Boerne Police Department responded to a call on July 14, 2024, reporting that someone had forcibly entered the back of a home using a knife. The subsequent investigation revealed that Niemeier unlawfully entered his mother's residence with the intent to commit theft. Evidence presented in court showed that after forcing entry, Niemeier confronted his mother, the victim, and made threatening statements that caused her to fear for her safety. These threats included phrases such as, "You better be ready, I'm coming for you," and "I will choke you with your lying tongue."
The victim informed officers that she was afraid of Niemeier and had resorted to placing cans in front of her door at night to alert her if he attempted to break in. At the time of his arrest, Niemeier was found to be in possession of a Gerber folding knife and a small hatchet. A multi-tool was also discovered in his vehicle.
A pre-sentence investigation (PSI) report detailed Niemeier’s criminal history, which included a prior conviction for Injury to a Child/Elderly/Disabled in Kendall County in 2017, stemming from an assault on an elderly individual. The PSI report indicated a total of four prior convictions. Probation Officer Jeneive Casarez recommended the 14-year prison sentence.
The Kendall County Criminal District Attorney’s Office praised the victim for her courage in reporting the crime and acknowledged the work of the Boerne Police Department officers, particularly the efforts of Detective Andrew Brzozowski.
